The PME Market Platform is dedicated to connecting and facilitating direct exchanges between business sellers and potential buyers. We also collaborate with specialized brokerage partners to facilitate the sale of businesses or economic entities for those who wish. Any use of the Platform implies your agreement to the provisions set out below.
By clicking "Accept" during your registration, you acknowledge that you fully accept these Terms. We recommend that you read them in their entirety before using our services or making any transaction through the Site.
Browsing the Site, creating an account or establishing any form of contact with other users constitutes full adherence to these Terms. Any use contrary to these provisions is at your own risk.
To access PME Market services, you must be at least eighteen (18) years old and have full legal capacity to enter into a binding contract. You are required to comply with all applicable laws and regulations.
Any attempt at unauthorized or fraudulent access to the Site is strictly prohibited. In the event of a violation, the Company reserves the right to take appropriate legal action.
The Company may at any time, and at its sole discretion, restrict or suspend access to the Site for any person or entity, particularly in the event of non-compliance with these Terms.
Our Platform's main objective is to enable meetings between sellers and buyers interested in the transfer or acquisition of a business, a going concern or a professional activity. We offer a simplified contact space and, where applicable, refer to brokerage partners to support transactions in greater detail if you wish.
We work with brokers specialized in the sale of businesses. On request, we can direct you to these partners to benefit from personalized support in your transfer or acquisition project. However, these services are exclusively subject to the terms agreed between you and our respective partners.
The Boost service is a paid option that increases the visibility of a listing for a period of seven (7) days on the Platform and on partner advertising networks selected by PME Market. The price is fixed, shown before payment, and covers both the promotion on PME Market and the advertising budget allocated to partner networks. The choice of distribution channels, budget allocation, and technical configuration of the campaigns are the sole responsibility of PME Market. Aggregated performance indicators of your boosted listing (impressions and clicks) are made available in your management area. The Boost service is firm and final: once subscribed, it is not refundable on a pro rata basis. By subscribing to this service, you agree that the public data of your listing will be distributed by PME Market on partner networks during the boost period.
You agree to use the Site in compliance with applicable laws and regulations as well as these Terms. You agree not to engage in any illegal, fraudulent, abusive activity or one likely to infringe the rights of others through our Platform.
You agree to provide accurate and truthful information and accept that the Company may carry out verifications if necessary. The Company reserves the right to close an account or refuse access to services in the event of false statements.
Each transaction initiated on the Platform is your sole responsibility. PME Market does not act as a financial intermediary nor guarantee agreements made between buyers and sellers.
You are prohibited from publishing on the Site any content that is illegal, offensive, defamatory, or infringes on the rights of third parties. You understand that any information voluntarily disclosed may be viewed by other users.
You agree to release the Company and its representatives from any liability for losses, claims or damages arising from your breach of these Terms or any applicable legal provision.
You warrant that you comply with all laws, regulations and obligations related to the transfer or acquisition of professional activities, including in terms of taxation, corporate law and intellectual property rights.
You affirm that you hold the necessary rights (or authorizations) for any content posted on the Platform, and you agree not to infringe on the intellectual property rights of third parties.
All elements of the Site (texts, visuals, logos, graphics, databases, etc.) are the exclusive property of PME Market or its partners. They may not be reproduced, modified or exploited without prior written authorization.
Your access to the Platform does not grant you any ownership or license rights to the content and elements therein, unless explicitly stated otherwise.
The personal information you provide is processed in accordance with Swiss data protection law. It is used to improve the quality of our services and facilitate connections between users.
Your data may be shared with our brokerage partners or other service providers when necessary or at your explicit request. We ensure that these third parties commit to respecting the confidentiality of this information.
The Company implements security measures to protect your data. However, we cannot guarantee absolute security against cyber attacks or unforeseen vulnerabilities.
Nothing in these Terms shall be construed as establishing an agency, partnership or joint venture between you and PME Market. You remain fully independent and responsible in your use of our services.
You agree to indemnify and hold harmless PME Market, its officers, employees and partners, from any claim or damage arising from illegal use or use contrary to the Terms.
The Company does not guarantee uninterrupted or error-free operation of the Site. To the extent permitted by law, no warranty, express or implied, is provided regarding the accessibility or suitability of the Platform for any particular purpose.
PME Market shall not be held liable for any direct or indirect damages (such as loss of revenue, loss of opportunities, or intangible damages) arising from the use of the Site or the inability to use it, unless the damage is attributable to gross negligence or intentional misconduct.
Transactions concluded via the Platform depend exclusively on the will of the parties. Furthermore, collaboration with brokerage partners is subject to specific conditions agreed directly between you and these brokers, and the Company's liability cannot be engaged in the event of a dispute.
The Company reserves the right to suspend or terminate your access to the Site at any time, particularly in the event of non-compliance with these Terms or any activity deemed detrimental to the Platform.
Upon termination, you will no longer be able to access PME Market services. The clauses relating to intellectual property, confidentiality and limitation of liability remain in effect even after access ends.
These Terms are governed by Swiss law. Any dispute falls under the exclusive jurisdiction of the courts of the Canton of Vaud, subject to any appeal to the Federal Tribunal.
We encourage any steps taken to resolve disputes amicably. For any questions or complaints, please do not hesitate to contact us to find a common solution.
Neither party may be held liable for any failure due to an event beyond its control (natural disaster, conflict, network failure, etc.) preventing the normal performance of obligations.
The Company reserves the right to update or modify these Terms at any time. Any revision will be indicated on the Site and will take effect thirty (30) days after publication.
